Criminal checks
Criminal checks are
normally performed by a company's department of
human resources
or a pre employment-screening agency, which
generally search a state's crime information
center database.
Preliminary criminal record checks are inquiries
of the aforementioned database using the
individuals name, Social Security number, and
date of birth only. A fingerprint criminal check
may be carried out by the States Bureau of
Investigation or the FBI by using a job
applicants fingerprints.
If you are a business owner who is concerned
about your work place safety and protecting your
profits, then you may want to consider
conducting criminal checks on all of you
applicants. Individual companies have mandated
that all directors and managers with in their
corporation submit to preliminary record checks,
as well as fingerprint record checks. In most
cases, criminal checks are performed before any
hiring decisions are made, while a select few
companies may continue background checks on a
random base throughout the individuals
employment.
A satisfactory criminal check is normally good
for twelve months, in some states. This means,
that if the employee moves, or changes employer
within this period, they should not have to
submit to another criminal records check.
However, they must have an original copy of
their satisfactory letter, photo copies are not
normally accepted by new employer. In addition,
if the home office of the new employer is based
in a state that does require criminal record
checks no matter the time between
checks, then the applicant may have to submit to
one in order to secure this position.
A majority of companies does not subject their
employees to another criminal check who remain
with them for years. There are exceptions, such
as if; there is a question of identity or an
abuse investigation. Another exception is when
it is stated in company policy that all
employees subject themselves to random
background checks throughout their employment.
Such companies would be those dealing with
National Security, and or Public safety and
health. Employees who wish to update their
criminal history records may go to the court
where they were originally charged, and ask
for assistance in this process. They however
must keep in mind that some charges remain on
ones record for life.
